Participant Waiver and Release of Liability

I, [Participant's Full Name], hereby acknowledge and agree to the following terms and conditions in consideration of being permitted to use the facilities and services provided by Compound Limited, including but not limited to the gym, bouldering wall, shower and toilet room (hereinafter collectively referred to as the "Facilities").

 1. Assumption of Risk:

I understand and acknowledge that the use of the Facilities involves inherent risks, including but not limited to the risk of personal injury, property damage, and even death. I voluntarily assume all such risks, and I understand that the activities offered at the Facilities require physical exertion and may be hazardous. 

2. Representations:

I represent that I am over the age of 16 and that I am in good physical condition and have no medical or other condition that would prevent me from using the Facilities in a safe manner. I understand the importance of following all safety instructions provided by Compound Limited staff and agree to do so at all times.

 3. Release of Liability:

In consideration of being permitted to use the Facilities, I, on behalf of myself and my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Compound Limited, its owners, officers, directors, employees, agents, and representatives (collectively, the "Released Parties"), from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including but not limited to personal injury, property damage, or death, that may be sustained by me while using the Facilities, whether caused by the negligence of the Released Parties or otherwise.

 4. Indemnification:

I agree to indemnify and hold harmless the Released Parties from and against any and all claims, demands, actions, or causes of action brought by third parties arising out of or related to my use of the Facilities.

 5. Data Protection (GDPR Compliance)

 I understand that Compound Ltd will collect and store personal data about me for the purposes of managing my membership and ensuring safety at the facility. I consent to this data being used appropriately for the duration of my involvement with Compound Ltd, in compliance with the General Data Protection Regulation (GDPR). I understand that I have the right to access, rectify, and request the deletion of this personal data at any time.

6. CCTV Surveillance

 I acknowledge that CCTV is in operation within and around the premises of Compound Ltd for security and safety purposes. Video recordings may be used to prevent theft, as well as to ensure the safety of members and staff. This footage may be reviewed by Compound Ltd management and may be provided to law enforcement if required by law.

I HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT BY PURCHASING A 24 HOUR ACCESS CODE, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
